CONDITIONS OF BUSINESS

NOTICE

Before selling, bidding for, or buying any vehicle it is important that these terms and conditions be read. All parties agree to accept these terms and conditions as binding on them and all vehicles are sold subject thereto unless otherwise expressly indicated by the auctioneer.

Every person entering these premises before, during or after sales shall be deemed to be there at their own risk and with notice of the condition of the premises and of the method of arranging Vehicles/Animals etc. Such person shall have no claim against the Auctioneer or Claremorris Auctions in respect of any injury sustained or any accident which may occur from any cause whatsoever. Children not allowed on premised unless with an adult.
All vehicles are entered at owners risk, no responsibility is taken for any loss or damage caused while on our premises, all damages and losses will be deemed to have existed before entry. No responsibility will be accepted regarding Anti Freeze in vehicles on the premises.
Entry fees must be paid on all items and vehicles at time of entry the appropriate rate and in cases of items re-entering in subsequent auctions an entry fee must be paid for each entry. Taxbooks and NCT & MOT Cert’s and discs, Tax discs must be handed in when entering.
The term “Sold As Seen” means the vehicle is sold with all its faults and defects and may or may not be roadworthy. It is the purchaser’s responsibility to satisfy themselves as to the road worthiness of a vehicle before bidding on it or driving it on a public road. All vehicles Sold As Seen may have been scrapped.
All vehicles are on vendors risk until the fall of the hammer and at the buyers risk after the fall of the hammer. The auctioneer or Claremorris Auctions will not be responsible for any loss of damage.
Claremorris Auctions is an agent between the seller and the buyer only and is not responsible for any details given by the seller or buyer. In particular Claremorris Auctions shall not be liable to pay the seller until payment is received from the buyer. Cash, Credit or Laser Card, Cheques with guarantee card are the only method of payment accepted for payments of vehicles or goods.
Claremorris Auctions gives no warranty as to the genuineness or authenticity of the vehicles sold and the buyer shall accept every lot with all faults and errors of description. Any description given by the auctioneer is the description which has been furnished by the seller. The auctioneer accepts no responsibility for any miss-description or error in description. Once the hammer falls no purchase shall be cancelled and no allowance can be made.
No warranty which means no guarantee is given by the auctioneer as to the Road-worthiness of the vehicle; the buyer has to pay for the vehicle or looses their deposit. After the sale is complete the vehicle shall be towed from the Claremorris Motor Auction premises.
The term “ No Major Defect” applies to the condition of the engine, gearbox, front drives, rear axle, chassis which must be operating normally. This can not apply to vehicles entering less than €2000 and that have been scrapped and repaired.
All vehicles put on the market and sold under the reserve on the instructions of the owner are binding and must be adhered to.
All potential buyers must get a bidding number to enable them to bid, if they are successful in purchasing a vehicle this is used as their deposit on the price of the vehicle. All buyers must pay an indemnity on top of the purchase price. This indemnity fees check’s the vehicles history, checks for finance, scrappage, stolen etc.
Claremorris Motor Auctions can not be held responsible for any milometer reading discrepancies given for any vehicle.
The auctioneer’s word on sales prices of vehicles is binding and must be accepted by purchaser.
The auctioneer if he deems necessary can refuse a bid from anyone who has previously broken auction rules.
Complaints concerning vehicles purchased with No Major Defect must be submitted to the management on there premise within one hour of the sale of the vehicle. No complaints whatsoever will be considered for vehicles Sold As Seen.
No private deals allowed, all sales whether made by the auctioneer or takes place as a result of the auction must be put through the office and commission must be paid, anybody found selling without putting it through the office will be charged double the commission.
All vehicles purchased at auction must have deposit left on them on the night of auction and purchasers must have vehicles paid for and removed from premises by 12 noon after 36 hours after the sale.
The seller will be paid after 7 days from when the auctioneer has been paid for same, and are asked to note a reasonable reserve helps sell your vehicle.
Any vehicle not paid for by 12 Noon Friday 36 hours after the sale Claremorris Auctions at their own descression will resell the vehicle and the previous purchaser will forfeit.
Claremorris Auctions will not be held responsible for any false declarations made by vendors whatsoever.

BUYERS : If you intend on buying or bidding on any vehicles that is going through the auction you must firstly register at the office of a bidders number. You must leave a deposit of

250(Car Auction) /500(ESB Auction) Euro and you will be given a bidding number which enables you to bid and is used as a deposit if you purchase anything, otherwise your 250/500 Euro is refunded when you return the bidding number.

When your bidding has been successful and you have purchased a car you must immediately approach the office and receive your docket of receipt for the deposit or if you wish to pay the full amount of the car. A Indemnity (Insurance) Fee of 50 Euro is charged on the sale of each car, this enables us to check the car for H.P.I (Finance), check with the Gardai and Motor Taxation Office that all is current, and check chassis etc.

CHANGE OF OWNERSHIP : When a car is paid for in full the new owner must then give us the name and address of whom the owner of the car will be and the new owner will then have to sign the Tax book /Licensing Cert, which will be sent to Dept of the Environment, Shannon, Co Clare. Only if you are a Garage or a registered dealer with a Garage Code, will you receive the Paperwork, and ownership of the vehicle will be transferred into buyers garage code.

SELLERS : If you intend on selling your car at our auctions we advise people to drop the cars up prior to the auction. Our office is open Mon to Fri 9am to 6pm and Wed all day so during the day or at 6pm on night of auction will leave you with plenty of time. The entry fee for putting a car through the auction is 50 Euro (Per Car Per Night) and if you sell the Sellers Commission is 10% on sale price up to €1000, 7.5% for Sale Price up to €3000 and 5% for Sale Price over €3001 with 21% Vat on the Commission ONLY. The Auction then takes 7 days to check the cars out for Finance, Scrappage, Check Chassis etc. Payments are issued 7 days after the date of sale, or the seller can collect his/her payment at the following weeks auction, all uncollected payments are posted out on the next day Thursday. We advise all sellers to bring all the paperwork and relevant information concerning the vehicle with them on the night of auction, if any paperwork is missing there will be no payment issued until we receive it in the office. Please take all removable Radio/Stereo/CD Players, NCT Discs, Tax Discs or personal property from the vehicle before leaving it at the auction.
